1. Who We Are and What We Do

Crystalium Booker (crystaliumbooker.com) is operated by Crystalium d.o.o., Partizanska 20L, Šibenik, Croatia (OIB: 49717943771). Crystalium Booker is an online booking platform that helps guests discover and get in touch with independent boat rental operators, skippers, and excursion providers ("Operators") across multiple countries.

2. Our Role as an Intermediary

We are not the owner, operator, or provider of any boat, vessel, excursion, or related service listed on our platform. Any rental agreement, charter, or excursion booking you enter into is a contract directly between you and the relevant Operator — Crystalium Booker is not a party to that agreement.

Crystalium Booker acts solely as an intermediary connecting guests ("you") with independent Operators.

As a result, Crystalium Booker assumes no responsibility or liability for: the condition, safety, seaworthiness, or legal compliance of any boat; the conduct, qualifications, or performance of any Operator or skipper; the accuracy of listings provided by Operators; cancellations, delays, or changes made by an Operator; or any injury, loss, or damage arising from the use of a boat or participation in an excursion.

We encourage you to communicate directly with the Operator to confirm all details, terms, and conditions of your booking before it is confirmed.

3. Bookings and Payments

Bookings and payments are arranged directly between you and the Operator, unless otherwise stated at the time of booking. Where Crystalium Booker facilitates payment of a booking fee, that fee relates solely to the use of our platform and intermediary service, and does not make Crystalium Booker a party to the underlying rental or excursion agreement.

4. Cancellations

Cancellation terms are set by the individual Operator and may vary by listing. Please confirm the applicable cancellation policy directly with the Operator before booking. Where Crystalium Booker has collected a booking fee and a booking is cancelled, we will handle the fee in accordance with the arrangement communicated to you at the time of booking.

5. Boat Owner / Operator Listings

If you list your boat or services on Crystalium Booker, you are solely responsible for the accuracy of your listing, holding all licenses, permits, and insurance required by applicable law, and complying with all safety and legal obligations relevant to operating your boat or excursion service. Listing on our platform does not create any employment, agency, or partnership relationship with Crystalium Booker beyond the intermediary services described in these Terms.

6. Acceptable Use

You agree not to use our website for any unlawful purpose, to submit false or misleading information, or to attempt to interfere with the proper functioning of the platform.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Crystalium Booker's liability is limited to the operation of our website and the intermediary booking service itself. We are not liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of a boat, participation in an excursion, or your dealings with an Operator. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including certain statutory consumer guarantees).

8. Intellectual Property

All content on this website, excluding content submitted by Operators about their own listings, is owned by or licensed to Crystalium Booker and may not be reproduced without our permission.

9. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Croatia. Any dispute arising from these Terms or your use of our platform shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Croatia, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.
